1. Provider and scope
MesaLibre is a software and website offering operated in connection with Altivision S.L. These terms apply to your use of the MesaLibre public website, onboarding flow, secure checkout handoff, and operator access once an account is provisioned.
If you access MesaLibre on behalf of a restaurant, hospitality group, or other legal entity, you confirm that you are authorized to bind that organization to these terms.
2. What MesaLibre provides
MesaLibre provides restaurant operations software and related onboarding, support, billing, and account-management services. Features may include reservations, floor and table workflows, guest management, payments, reporting, communications, menus, stock, integrations, and other documented product modules.
We may improve, refine, suspend, or retire features when necessary for security, legal compliance, platform integrity, or product maintenance. Where practical, material changes will be reflected in the public product information or communicated through the relevant account channels.
3. Onboarding, checkout, and subscriptions
Public onboarding may offer a free-trial start or an immediate paid start. In both cases, checkout is completed through a secure payment-provider flow. The commercial start mode shown during onboarding governs when billing begins.
Submitting onboarding details does not by itself guarantee account activation. Account provisioning and access depend on successful checkout, payment-provider confirmation where applicable, and MesaLibre's ability to complete the setup workflow.
Subscription pricing, billing cadence, and commercial inclusions are those shown at the time of checkout or otherwise agreed in writing.
4. Account information and responsibility
You must provide accurate, complete, and up-to-date onboarding, billing, and account information, including the restaurant or group name, primary contact, and work email used for the account.
You are responsible for keeping account credentials confidential, controlling who is authorized to use the service on your behalf, and promptly notifying us if you suspect unauthorized access or misuse.
5. Acceptable use
You may not use MesaLibre in a way that is unlawful, fraudulent, deceptive, abusive, security-invasive, or likely to impair service availability for other customers. This includes attempts to bypass access controls, interfere with tenant isolation, extract data without authorization, or reverse engineer protected portions of the service except where mandatory law permits it.
You remain responsible for the lawfulness of the operational, guest, billing, and communication data you enter into the platform and for ensuring that your own restaurant workflows comply with applicable law.
6. Fees, invoices, and non-payment
Paid subscriptions, invoice issuance, payment-method handling, and retry or dunning steps follow the commercial terms applicable to your account. Unless a trial or separate written arrangement says otherwise, charges become due according to the subscription plan selected during onboarding.
If payment cannot be collected, MesaLibre may restrict account actions, suspend access, or delay further provisioning until the billing issue is resolved, subject to any mandatory notice or grace-period obligations that apply.
7. Data protection and confidentiality
Our handling of personal data is described in the Privacy Statement. You should review that statement together with these terms before starting onboarding or using the service.
Both parties must treat non-public operational, commercial, and security information obtained through the relationship as confidential and use it only for the legitimate performance, support, or administration of the service, except where disclosure is required by law.
8. Intellectual property
MesaLibre, the public website, brand materials, software, designs, text, and related content remain the property of MesaLibre, Altivision S.L., or their licensors unless expressly stated otherwise.
Subject to these terms and any paid subscription in force, we grant a limited, non-exclusive, non-transferable right to use the service for your internal restaurant or hospitality operations.
9. Availability, warranties, and liability
MesaLibre is provided on an "as available" and "as updated" basis. We work to keep the service secure and reliable, but we do not promise uninterrupted operation, perfect compatibility with every third-party environment, or error-free availability at all times.
To the maximum extent permitted by applicable law, MesaLibre and Altivision S.L. are not liable for indirect, incidental, special, or consequential losses, or for loss of profit, goodwill, or anticipated savings arising from use of the service. Nothing in these terms excludes liability that cannot legally be excluded.
10. Suspension, termination, and survival
We may suspend or terminate access where necessary for security, non-payment, unlawful use, material breach, or platform-protection reasons. You may stop using the public website at any time and may request account closure subject to outstanding legal, billing, audit, or data-retention obligations.
Clauses relating to payment, confidentiality, intellectual property, liability, audits, and legal compliance survive termination to the extent reasonably necessary.
11. Governing law and contact
Unless mandatory law requires otherwise, these terms are governed by the laws of Spain. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Alicante, Spain, without prejudice to any mandatory rights or venues that apply under law.
